Please read these terms before using FourthTrim. By using the app, you agree to these terms. If you don't agree, please don't use the app.

Medical Disclaimer: FourthTrim is a wellness app, not a medical device. Nothing in FourthTrim constitutes medical advice, diagnosis, or treatment. Always contact your doctor, midwife, or healthcare provider for medical questions — especially concerning postpartum physical or mental health. If you are in crisis, please contact emergency services or a crisis hotline immediately.

1. Acceptance of Terms

By downloading, installing, or using FourthTrim ("the App," "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are accessing the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

FourthTrim is a postpartum recovery companion app that provides:

Daily check-ins to track mood, energy, sleep, and physical recovery
A personalized recovery score and trend tracking
An AI-powered chat companion for emotional support and general wellness information
Recovery circles — anonymous peer community support organized by postpartum week
Partner mode — optional data sharing with a trusted partner
Breathing exercises, milestone tracking, and a weekly recovery letter

3. Eligibility

You must be at least 13 years old to use FourthTrim. By using the App, you confirm that you meet this requirement. FourthTrim is designed primarily for postpartum individuals and their partners.

4. Not Medical Advice

FourthTrim is designed to support your wellness journey — not to replace professional medical care. Specifically:

The AI companion provides general emotional support and wellness information only
Recovery scores are calculated from self-reported check-in data and are for personal insight only
FourthTrim does not diagnose postpartum depression, postpartum anxiety, or any other condition
If you are experiencing a mental health crisis, thoughts of self-harm, or medical emergency, call 911 (US) or your local emergency number immediately

5. User Accounts and Device Identity

FourthTrim does not require you to create an account with a name, email, or password. Your identity within the app is an anonymous random device ID stored on your device. You are responsible for keeping access to your device secure. If you lose your device or uninstall the app, your server-side data may not be recoverable (it will remain on our servers but you may lose the device ID needed to access it).

6. Community Standards (Recovery Circles)

The Recovery Circles feature allows anonymous posting to peer support groups. By posting, you agree not to:

Post content that is harassing, abusive, or threatening toward others
Share personal identifying information about yourself or others
Post spam, commercial content, or links to external sites
Impersonate medical professionals or give specific medical advice
Post content that glorifies self-harm or encourages dangerous behavior

We reserve the right to remove any content that violates these standards and to block devices that repeatedly violate them.

7. Subscriptions and Payments

FourthTrim offers a free tier and an optional premium subscription ("FourthTrim Premium") with additional features. Subscriptions are processed through the Apple App Store. By subscribing, you also agree to Apple's terms and conditions. Key subscription terms:

Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period
You can manage and cancel your subscription in your Apple ID account settings
We do not offer refunds outside of Apple's refund policy
A free trial, if offered, will automatically convert to a paid subscription unless cancelled before the trial ends

8. Intellectual Property

The FourthTrim app, its content (excluding your personal check-in data and conversations), and all related intellectual property are owned by FourthTrim and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App without our written permission.

Your check-in data and conversation content belong to you. By using the App, you grant us a limited license to process and store this data solely to provide the Service to you.

9. Limitation of Liability

To the maximum extent permitted by applicable law, FourthTrim and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or profits, arising from your use of the Service. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid for the Service in the 12 months preceding the claim (or $100 if you have not paid anything).

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

11. Changes to the Service

We may update, modify, or discontinue features of FourthTrim at any time. We will try to provide reasonable notice of significant changes. Continued use of the App after changes constitutes acceptance of those changes.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated in the app. Your continued use of FourthTrim after changes take effect constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in a court of competent jurisdiction in the United States.
